Course overview
This will be a session looking at procurement in major projects in particular we will look at:
• when to use Competitive procedure with negotiation and when to use Competitive dialogue;
• how best to structure large projects and the procurement;
• evaluation criteria in particular how to ensure that the criteria don’t prevent or stifle innovation;
• how to deal with challenges to the procurement exercise both during the process and afterwards with particular attention to confidentiality rings
• how to draft long term agreements in particular making sure change control works for the purposes of regulation 72;
• innovation partnerships, what they are and when might they be used.

Presenter profiles:
Peter Ware, Partner and Head of the Government and Infrastructure Team at Browne Jacobson, takes a lead on the commercial aspects of the local authority practice specialising in complex procurement, shared services, state aid, outsourcing and public sector joint ventures. Prior to joining Browne Jacobson Peter worked as a special projects adviser for Nottinghamshire County Council. His extensive knowledge of local authority law and his time leading major projects for various clients has given him a wealth of experience in advising all types of public bodies on commercial matters, in particular their public procurement, PPP and commercial work. He is also an active member of the national executive committee of the Procurement Lawyers Association.
Anja Beriro is an associate in the government and infrastructure team at Browne Jacobson. She specialises in non-contentious procurement matters as well as providing general commercial and governance advice to a wide range of public authorities. Anja’s public sector legal experience has been built through time spent in both the public and private sector and she has previously worked for Sheffield City Council.
