Course overview
Suitable audience:
In-house lawyers; any legally trained staff members, anyone who deals or negotiates contractual documents or is involved with risk management; debt recovery or issuing and enforcement of Court claims.
Overview:
An update on the Civil Procedure Rules, a look at a number of interesting and important cases from the last 12 months, focusing particularly on changes to the CPR, remedies as a result of breach of contract, and important general cases for litigators and those involved in debt collection.
We will also look at the latest position on ensuring legal privilege and how this sits with FOI, sensitive issues for Local Authorities and Public bodies to minimise risk and how to deal with PR in relation to litigation claims.

Presenter profiles:
Philippa Dempster, Freeths has 25 years’ experience, she has a Masters Degree in Advanced Litigation, is a qualified mediator, has been regarded by Legal 500 and Chambers as a Leader in the Field and is featured in Best Lawyers and The Lawyer Hot 100 for 2017.
Robert Hill is an Associate in the Dispute Resolution team, having spent over 8 and a half years at Freeths. He is a litigator dealing with disputes and he has experience of litigation in a range of different courts, including the County Court, Property Chamber and High Court. Robert deals with a range of different cases, but primarily on contractual, property and trust matters. His contractual practice focuses primarily on breach of contract claims, including disputes over the construction of contracts, disputes concerning express and implied terms and termination disputes.
James Gorman, Associate at Freeths is a Dispute Resolution solicitor with 9 years experience assisting a wide range of clients from listed PLCs; limited companies and local authorities to resolve their disputes in a quick and cost effective manner. Specific areas of expertise include:
• Complex contractual disputes including warranty claims following the sale of a business; shareholder disputes; insurance claims and claims brought by individuals against local council
• Commercial and retail fraud

Vickie Nijaar, Freeths has over 10 years experience in commercial dispute resolution. She is familiar with all stages in the process from pre-action negotiations through to trial and tries, where possible, to settle claims and disputes without the need for litigation. She has acted for large national and international clients in complex contractual disputes against the Ministry of Justice, the Home Office and the Department for Work and Pensions in relation to interpreting and exiting contracts relating to managed service solutions, each of which had significant wider commercial and political considerations and were of a highly sensitive nature as well as highly confidential. She has taken cases to expert determination resulting in decisions being made in a matter of months. She is also experienced in insolvency matters. She acts for Insolvency Practitioners bringing claims against directors in relation to antecedent transactions, misfeasance and wrongful/fraudulent trading as well as defending directors in respect of these claims. She also advises directors in relation to disqualification proceedings.
She acts for a wide range of clients including multinational companies Insolvency Practitioners (including International IP’s), Outsourcing companies, Insurers, Breweries, Construction Companies, Property Managing Agents, Professional Sports Teams, Events Organisers and Landowners in sectors such as Food and Drink, Entertainment, Manufacturing, Sports and Banking and Finance. Vickie also advises on breach of warranty claims, partnership disputes and claims in relation to breach of fiduciary duties as well as charitable trusts including cases that may require third party professional funding including sourcing ATE insurance cover.
