Course overview
Suitable audience:
Adult social care teams, particularly social workers and deputyship teams. The course is an extended version of a talk given to East Midlands Association of Public Authority Deputies in October 2016.
Overview:
An introduction into specific claims one might encounter whilst managing the finances of service user or working with vulnerable people, and how to spot claims which a service user might have made against them or might have against another’s estate.
Topics to be covered include:
• Disputed Court of Protection applications
• Deputyship / attorney / trustee removal
• Beneficial interests in property
• Financial abuse
• Statutory wills
• After death claims
• Mental capacity
• Undue influence
• Trust disputes

The course will include case studies based upon real life cases handled by the team at Freeths and will include an opportunity for question and answer sessions.

Presenter profiles:
Robert Hill is an Associate in the Dispute Resolution team, having spent over 8½ years at Freeths. He has is a litigator dealing with disputes and he has experience of litigation in the County Court, Court of Protection, Property Chamber and High Court. He deals with a range of different cases, but primarily on contractual, property and trust matters.
Robert’s trust and probate practice includes contentious Court of Protection Matters, trust disputes and trustee removal, mismanagement of finances by deputies / attorneys, Inheritance Act claims, claims for beneficial ownership in property and will challenges.
Jemima Barnes has worked at Freeths since 2010 and qualified into the Dispute Resolution department in September 2016. She acts for a variety of different of clients, handling a broad range of civil litigation cases.
Jemima focuses mainly on contentious probate and court of protection matters, together with a litigation practice providing advice on employment, property, professional negligence and contractual disputes for private individuals and commercial clients.
