Theme: Drafting Commercial Contracts

Course overview

The course will consider principles relevant to contract drafting and discuss how to apply these practically to draft effective contracts. Subjects covered in the course are expected to include:

• The interaction between procurement and drafting
• Updating the drafting of contracts in the light of legal developments
• Contract management
• Plain English drafting

Suitable audience:

Local authority lawyers who are involved in drafting contracts. It is assumed that those attending will have some experience of drafting contracts.

Interactive elements

The course will include group discussion and those attending will be encouraged to raise issues that they have come up against in contract drafting.

Duration: Half a day (3 training hours) including lunch

Presenter profiles:

Michelle Craven-Faulkner, Geldards is a well-respected commercial contracts lawyer with a strong background having worked in-house for many years prior to joining private practice.

Michelle has a real ability to understand her Clients’ requirements in order to document them in a way that is clear, concise and user friendly.

With a particular expertise in cross border arrangements and often for Clients who are highly innovative both in terms of products (goods and or services) and contracting structure, Michelle works closely with Clients in all sectors to achieve solutions which work for them rather than attempting to mould Clients into.

In addition Michelle provides advice on all aspects of the supply and purchase of assets, goods and services with a particular interest in engineering and major projects. Her background in industry brings a strong connection to the rail sector which is a particular specialism as is her work with renewable energy companies.

Nick Pearson, Geldards has a broad range of commercial contracts experience, with a particular focus on rail having spent two years at HS2. Nick provides commercial advice across various sectors, including rail, IT/IP/Telecoms and energy.

Vincent King, Weightmans is a projects and commercial lawyer. He advises public sector clients on outsourcing, long-term contracts for the supply of services and funding agreements. He has particular experience in the local government, higher education and police sectors. Vincent has established a variety of contractual and corporate structures including partnering arrangements and shared services and has advised local authorities on the transfer of services and assets to new delivery vehicles.

Victoria Robertson, Weightmans undertakes commercial work within the private and public sector. She regularly drafts trading terms and introducer, services, goods, agency and distribution agreements. Victoria provides commercial advice to police forces, local authorities and universities.
